(二)申请条件Application Conditions

只有符合以下情形的，才可按境内办理外国人来华工作许可申请:

Only individuals meeting the following conditions are eligible to apply for a Foreigner's Work Permit within China:

（1）持其他签证或有效居留证件已入境的外国高端人才（A类），包括外籍博士后；

(1) Foreign high-end talents (Category A) who have entered with other visas or valid residence permits,including foreign postdoctoral fellows.;

（2）在华工作的外国人变换用人单位，但工作岗位（职业）未变动，且工作类居留许可在有效期内的；

Foreigners changing employers in China but with no change in job position (occupation), and with a valid work-type residence permit;

（3）中国公民的外籍配偶或子女、在华永久居留或工作的外国人的配偶或子女，持有效签证或在有效期内的居留许可的；

Spouses or children of Chinese citizens who hold valid visas or residence permits, or spouses or children of foreigners with permanent residency or employment in China who hold valid visas or residence permits;

（4）持R字签证申请工作许可；

Applying for a work permit with an R visa;

（5）符合自由贸易区、全面创新改革试验区相关优惠政策的；

Eligible for relevant preferential policies in free trade zones or comprehensive innovation and reform pilot zones;

（6）用人单位符合享有跨国公司在华地区总部相关优惠政策的；

Employers eligible for relevant preferential policies as regional headquarters of multinational corporations in China;

（7）企业集团内部人员流动的；

Internal personnel mobility within enterprise groups;

（8）执行政府间协议或协定的；

Implementing government agreements or treaties;

（9）已持工作签证依法入境的驻华机构代表人员；已获得来华工作90日以下的外国人来华工作许可，在其停留有效期内，被境内用人单位依法聘用的；

Representatives of institutions stationed in China who have entered lawfully with a work visa; foreign nationals who have obtained a work permit for a stay of less than 90 days to work in China, and who are lawfully employed by domestic employers during their stay validity period;

（10）其他审批机构认定符合条件的。

Other conditions recognized by approval authorities.

若不符合以上情形，但申请人已在境内，仍须按境外办理外国人来华工作许可申请（境外申请外国人来华工作许可）

If the applicant does not meet the above conditions but is already in China, they must still apply for the Foreigner's Work Permit from abroad.

（三）办理步骤Procedure

境内申请工作许可业务时，可选择一起办理居留许可，同时办理外国人来华工作许可证和工作类居留许可（申请所材料请根据文件下载中人员类型不同下载对应的申请清单和附件）。

When applying for a work permit within China, applicants have the option to concurrently apply for a residence permit. This process involves applying for both the Foreigner's Work Permit and the residence permit for work purposes simultaneously.
